CLLA Member, Mr. Sather received his B.A. summa cum laude in economics and political science from Texas Lutheran University and his J.D. with Honors from the University of Texas School of Law, where he was named to the Order of the Coif. He was admitted to the Texas Bar in 1986 and is board certified in Business Bankruptcy Law by the Texas Board of Legal Specialization and the American Board of Certification. He is also admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Fifth Circuit, all four United States District Courts in Texas and the United States District Court for the District of Colorado.
Mr. Sather is a member of the State Bar of Texas, the Commercial Law League (member of Bankruptcy Section Executive Council and principal author of amicus brief), the American Bankruptcy Institute, the Federal Bar Association and the Austin Bar Association. He has served as president and treasurer of the Bankruptcy Section of the Austin Bar Association. He is a member of the State Bar College and a Life Fellow of the Texas Bar Foundation. He has been selected as a Texas Super Lawyer by Thomson Reuters for years 2006-2012, was named as a Top-Rated Foreclosure Attorney by Business Week in 2008 and appeared in Best Lawyers in America since 2010.
Mr. Sather is a frequent author and speaker on bankruptcy topics and has been invited to present papers to conferences sponsored by the University of Texas School of Law, the State Bar of Texas, the National Association of Attorneys General, the States Association of Bankruptcy Attorneys and the United States Justice Department (U.S. Trustee, Region 7). Mr. Sather has written over 250 articles for A Texas Bankruptcy Lawyer’s Blog, which can be found here. He has published scholarly articles in the American Bankruptcy Institute Law Review, the Journal of Bankruptcy Law & Practice, the Texas Tech Administrative Law Journal, St. Mary’s Law Review, the American Bankruptcy Institute Journal, the Texas Bar Journal and Debt3 (the journal of the Commercial Law League) among others.
Mr. Sather has represented debtors, creditors, trustees and committees in cases under every chapter of the Bankruptcy Code. His practice includes representing financial institutions, landlords, judgment creditors and debt collectors in bankruptcy cases and adversary proceedings. He has represented clients in over a dozen appeals to the Fifth Circuit, resulting in published opinions such as Reed v. City of Arlington, 650 F.3d 571 (5th Cir. 2011)(en banc); Camp v. Ingalls (In re Camp), 631 F.3d 757 (5th Cir. 2011); Matter of Gupta, 394 F.3d 347 (5th Cir. 2004); Matter of CompuAdd Corporation, 137 F.3d 880 (5th Cir. 1998), In re Educators Group Health Trust, 25 F.3d 1281 (5th Cir. 1994); Matter of Dyke, 943 F.2d 1435 (5th Cir. 1991); and Matter of Greystone III Joint Venture, 995 F.2d 1274 (5th Cir. 1991).
In 2008, Mr. Sather received The Constant Gardener Award from Advocacy, Inc. for his commitment to pro bono matters and the Judge Suzanne Covington Pro Bono Service Award from Volunteer Legal Services. Mr. Sather’s community service includes serving on the school board of St. Martin’s Lutheran School (including two years as board president), serving as Vice-President of Division III and Vice-President of Referees for the Austin United Capital Soccer Club, serving as an election judge for Travis County and serving as a volunteer mediator for the Travis County Dispute Resolution Center.
