Mr. Warnecke is a partner with Lowis & Gellen, LLP in the Litigation Practice Group with a primary focus on patent, copyright, trademark and trade secret matters. He has first chaired patent, copyright, trademark, and trade secret litigation matters in a variety of venues, including district courts throughout the United States and Section 337 actions before the U.S. International Trade Commission (ITC). For example, Mr. Warnecke represented a large Taiwanese corporation in an ITC action defending against allegations of infringement of three patents allegedly covering the company’s PCs, motherboards, notebooks, and graphics cards and seeking to exclude billions in U.S. sales. In addition to managing all aspects of the case through trial and post-trial, Mr. Warnecke also conducted direct examination of experts and cross examination of key witnesses. The Taiwanese company prevailed on all three patents with findings of no infringement and the full Commission adopted the ALJ’s Initial Determination without review.
Mr. Warnecke is registered to practice before the U. S. Patent and Trademark Office (USPTO) and has significant experience in drafting and prosecuting patent applications and rendering opinions covering patent validity and infringement. His technical experience is broad, ranging from medical devices and consumer electronics to software algorithms and microchip technology. In addition, he also has extensive experience representing entities and artists in copyright infringement matters, particularly in the music realm.
