Shelley Kinsella

Shelley A. Kinsella, managing shareholder at Elliott Greenleaf’s Wilmington office, focuses her practice on bankruptcy and employment law matters.

She has experience in complex Chapter 11 reorganization and liquidation cases, representing debtors, unsecured creditors’ committees, trustees, and secured and unsecured creditors. She has also prosecuted and defended hundreds of bankruptcy avoidance and fraudulent conveyance actions, as well as managed the claims objection process for various debtor estates.

Ms. Kinsella also mixes her bankruptcy practice with employment and health care law issues. She recently has represented one of the country’s first official committee of long-term disability plan participants in the Nortel Networks, Inc., et al. chapter 11 bankruptcy case, as well as a former employee in a whistleblower / wrongful termination action in the Point Blank Solutions, Inc., et al. chapter 11 bankruptcy case.

She also represents employers in discrimination cases before the Delaware Department of Labor and Equal Employment Opportunity Commission, including actions under Title VII of the Civil Rights Act of 1964, as amended, the Age discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, and the Delaware Discrimination in Employment Act, as well as providing counsel regarding general employment law matters.

Ms. Kinsella completed the American Bankruptcy Institute’s 40-hour Bankruptcy Mediation Training program and is a member of the Register of Mediators and Arbitrators for the United States Bankruptcy Court for the District of Delaware.

Ms. Kinsella is admitted to the Delaware Bar and the United States District Court for the District of Delaware. Ms. Kinsella resides in Wilmington with her husband and two children. She has provided volunteer services for Alternative Court for Teens, ReadAloud Delaware, and the Office of the Child Advocate. She currently is a member of the Human Rights Campaign, working for Lesbian, Gay, Bisexual and Transgender Equal Rights.

Ms. Kinsella earned a Bachelor of Arts with honors in Political Science and a minor in English from the University of California, Irvine. She graduated from Loyola Law School, Los Angeles, where she was a member of the Moot Court team and was an ABA National Finalist. She was also Senior Articles Editor for the Entertainment Law Review.
