Involuntary, and even voluntary, terminations are seldom pleasant, but they are an inevitable part of business. Whether an employee is being let go due to poor performance, serious misconduct, or lack of work, chances are that they will take issue with the decision.
In the event the terminated employee decides to complain to a federal, state, or local regulatory agency or meet with a plaintiff’s attorney, it is important that the employer has taken steps to minimize risk to give the organization its best chance to defend against claims of discrimination, retaliation, or wrongful discharge.
